Hey Ags, I'm selling my Lake McQueeney waterfront property (lake house and lot) if any of you are interested please let me know immediately. Selling for approximately $800k which is one of the lowest waterfront prices available for a desirable location and property on that lake --- it will go fast! Interested in getting back in the area. But have a couple questions for you Ag.

-What is the story with Guadalupe Blanco River Authority draining the lakes & fixing the dams? Seems like the news not long ago was showing a spill gate failure at Dunlap or maybe it was closer to Gonzales? Both?

-How much was underwater October '98?

McQueeney is nice spot Army.
Last Fall the 600 waterfront property owners voted (85% plurality approved) taxing themselves to fund reconstruction of the dam and reconstruction will begin sometime in the next year. Lake Dunlap's dam's spill gates did fail last year and construction to repair them has just begun. Dunlap is immediately upstream from Lake McQueeney but has a much lower tax base. The lake house for sale had approx. 18" of water during the flood of record in 1998, no other flood (before or since) has even been close to the house because its the natural grade elevates above the lake elevation. thats a beautiful area. Im several years away from something in that price range, but I know that it will go quick.

Things are interesting in the legal front again. I'd be careful buying on any of the GBRA lakes, they are snakes with deep pockets and will not stop until their goal of dewatering is complete. I'd guess next stop in court is TX Supreme Court.

Quote from last paragraph of the opinion. " Because appellants lack standing on this record, we reverse the trial court's judgment on appellants' takings claims, affirm the trial court's dismissal of all other claims, and remand for further proceedings consistent with this opinion."

This above referenced lawsuit has nothing to do with the plan approved by the community to create a WCID and rebuild the dam.

The lawsuit is a separate effort to essentially get GBRA to fund everything. A definite windfall for the community if ultimately successful, but not of any impact or relevance of the approved plan to move forward for McQueeney and Placid.

Lots of details here on the plan for McQueeney. Placid and Dunlap are moving forward with similar plans.

Which lawsuit got the TRO to stop draining the lakes? I can't keep up but I though that was the Sutter suit. If it was doesn't this green light GBRA to dewater?

NADA! The GBRA messed with the wrong tax base, plenty of wealthy property owners to tie them up in the courts for a long time and they know it. That's why they reluctantly agreed to an agreement with the newly created WCID.

The injunction resulted from the initial set of hearings of the two combined lawsuits filed in close proximity against GBRA.

The Settlement agreement in the "other " lawsuit and the resulting agreement between GBRA and the WCID also provide that GBRA will maintain the lake levels until construction begins on the repairs.

So, sort of a belt and suspenders situation.



Settlement Agreement Reached

The Guadalupe-Blanco River Authority (GBRA) has reached a settlement agreement with property owners from Lake McQueeney and Lake Placid in the case of Skonnord v. GBRA, represented by San Antonio attorneys Ricardo Cedillo and Les Strieber. The settlement anticipates the execution of comprehensive financing and operation contracts between GBRA and the newly created Water Control Improvement Districts (WCIDs) on each lake. These contracts will address the specifics of the spillgate replacement and dam repair. Per the settlement agreement, GBRA will continue maintaining the current operating levels on each lake until work begins on the spillgate replacement and repairs on that lake's dam.

I believe GBRA will operate the dams and generators (if repaired) after construction going forward as part of the agreement. I am down river on Lake Placid.

I stand corrected. Still seems silly there is no recourse to GBRA for neglect. The residents should be able to sue the entity regardless if it's a government organization or not.

I can't find it but I'm sure there's verbiage stating that GBRA can never dewater after new damns are built. Seems like they'll charge homeowners for new damns then pull the water out just for spite. Power and water hungry is what they are and water is the booming commodity in central TX.

Thanks Arb and thanks all. A lot of moving parts here, suspect I'll stay away. Apparently the Guadalupe Blanco River Authority didn't keep up maintenance or budget for any real repairs and now the property owners nearby have to pony up. I understand them saying yes vs living along the newest dry gulch. Didn't the same folks pay higher property taxes over the years?

Yes, the GBRA has epically failed to perform its responsibility to maintain its own infrastructure, just one more state agency who's corruption knows no bounds. As usual, the residents have to come in and pick up the pieces and save the day from incompetent politicians and appointees.
That said, McQueeney is a wonderful edge of hill country spot with great water and unparalleled recreational activities. A truly great retreat following Aggie game weekends.

Potentially interested if it hasn't sold. Have you ever rented it out and had success if you did? Or if not do you know if there are rules against it?

I would want to be able to rent it out when we aren't using is.

It hasn't sold yet West Tex but will been formally listed with Keller Williams tomorrow (the 19th), if you're potentially interested I need your name ASAP to reserve you and save 6-8% on the sales price attributable to brokerage fee. I was hoping to sell to another Ag and keep the maroon theme going on the lake.
Yes, you can rent it or VRBO it, another lake house 2 doors down does that all the time. Visitors love the lake and almost always return.
