Well they could have and they did but LZ would not give them the rights to "Rock and Roll" which Linklater wanted to use (not "Dazed and Confused" oddly).

LZ wasn't licensing music back then they were still reclusive about it. From the mid 80s until the late 90s and 00s they approved nothing until Sopranos and Almost Famous and later in Argo.

LZ famously had been used in Fast Times (Kashmir) in the early 80s and they got permission but since then they had stopped licensing as the band could not agree on anything for about 15 years.

yeah i knew about that one too.. Jack Black's plea to LZ to let them use it is epic. It was in the link you had but thought I would just put it out here. he gives an intro and it starts about :30 in.
