I don't think the DOJ gets to decide who can sue whom. OP highlighted wrong paragraph. The DOJ was in an appeals court not granting an authority but was PLEADING with the judiciary to take UNPRECEDENTED steps against a CANDIDATE for POTUS.

This is why libs can never ever be trusted or allowed to hold office again. They think this is just fine.

President is immune from the law during office outside of impeachment, treason and I believe the emoluments clause.

Can't wait to see Trump's lawyers request a "joinder" to add the DOJ and FBI as proper parties to each civil lawsuit.

When that happens, the attorneys in the "discovery" phase of the case can obtain the identity of the "infiltrators" and "instigators" and discover the tactics used by the DOJ and FBI things they fight to keep secret.

Pandora's Box once opened cannot be fully closed after this occurs.

you are wrong about this. even Trump's attorney's aren't arguing there is absolute immunity for anything a president does. its a broad immunity, meant even to protect things on the outer perimeter of a president's official duties, but there could be exceptions.

the president is not immune from the law. this is a civil suit, so has nothing to do with "high crimes and misdemeanors" that relates to criminal activity and abuse or violation of the public trust. constitution does not mention civil case immunity, it stems from separation of powers.

a president has absolute immunity from civil suit related to his official acts and role as president. if a president walks into the denver post office and says "all of the jews and blacks are fired" he can't be sued personally for that. if he takes his car out for a late night taco bell run and side swipes someone, he could be.


for purposes of the lawsuit, the court is to take well plead allegations as true. so lets say for a moment Trump was inciting a riot or insurrection (which is funny because at oath keepers trial, it was learned that those people actually doing an insurrection were mad Trump didn't give them the go ahead). This was all done in Trump's last speech as president talking about election security. That is clearly within the outer perimeter of his official acts.


this DoJ brief is funny. It claims its not taking a position on the merits, but then does just that. It doesn't set forth any law that wasn't already cited by both the plaintiffs and Trump, or that wasn't already known to the Court. Instead it tries to act like its just reciting its position on the law, when its really trying to shoehorn specific facts into the case law. not surprising from a leftist DOJ
