Additionally, the Parkland shooter PLED GUILTY to his offenses to AVOID the death penalty. Florida prosecutors WERE, in fact, seeking the death penalty in the case and had, shortly after the indictment declined the defense's offers to plead in lieu of a death sentence. For whatever reason that change 2-3 years later right before the case would go to trial.

The bar for death penalty is high, and given the fact that this guy is getting huge sympathy from his peers juat shows what this judge sees in the outcome based on this decision.

I would argue stalking for the purpose of killing a person is part of a violent crime showing premeditation. If it can be charged separately, it is a separate crime.
Crossing state lines for the purposes of committing a violent act, is itself a violation of the Travel Act.
So I really don't understand the judge's reasoning here.
Question for hawg. So, does this mean that, in New York, you can commit premeditated cold blooded murder, as long as it is not in conjunction with another violent crime, and not face the death penalty? If so, the death penalty in NY is moot really. Murder in conjunction with armed robbery, for instance, is not premeditated.

He isn't. He's also putting the cart before the horse a bit. Death penalty is a sentencing decision, not a charging decision. After trial and a verdict he can address it then, or just refuse to instruct the jury on them, if he so determines there was not enough evidence adduced at trial to support them.

At this stage? Limited. Appealing this decision in pretrial requires the judge to allow it usually.
But OTOH this decision has further effects on admissibility of evidence of those other acts, if push comes to shove. Judge theoretically could refuse to admit that evidence under this ruling.

Quoting myself here with an update. FNC is reporting this decision along with the accompanying order regarding admissibility of the contents of his backpack (judge will let it in ) will also be appealed at the same time.
