Is there an obligation of state governments to help enforce immigration law? Or is there merely an obligation to get out of the way? The devil will be in the details of this suit. If they are being charged with simply not helping I don't think it can go anywhere. If they're being accused of openly harboring and blocking enforcement, that's a different animal.

No way, they'd charge without a bunch of base hits, lots of home runs, and a couple of grand slam walk-offs just in case, right?

Or using federal funds regarding immigration enforcement improperly, perhaps. Or causing federal dollars to have to be spent in excess of what should have been required due to deliberate activities, maybe? It's hard to say what would rise to legal responsibility at the state level regarding immigration

Exactly, can you imagine some conservative politicians tipping criminal syndicates off to upcoming FBI or DEA raids? Imagine how they would be treated.

AG can file charges without empaneling a grand jury, called filing by information. There is also a civil component to RICO that many people forget about. Not saying RICO implications here but just a thought.

She said they have a tip off policy to notify illegal immigrants if Federal agents inquire about them. That seems like a clear violation.
