Quote:

A federal judge has delivered a blow to President Trump's USAID spending freeze with an order that demands he reinstate funds for hundreds of foreign aid contracts.

Judge Amir Ali issued the order on Thursday in response to a lawsuit brought about by companies receiving the funding for programs abroad.

Ali, a Washington DC judge appointed by former president Joe Biden, accused the Trump administration of an 'arbitrary and capricious' act in halting the funding.
Quote:

He said the decision to suspend funding for 90 days while conducting a thorough review of each contract and its validity has not been justified or rationalized.

'At least to date, Defendants have not offered any explanation for why a blanket suspension of all congressionally appropriated foreign aid,' he said.

Instead, he said the decision has 'set off a shockwave and upended... thousands of agreements with businesses, nonprofits, and organizations around the country.

'Absent temporary injunctive relief, therefore, the scale of the enormous harm that has already occurred will almost certainly increase.'

The ruling marks the first to temporarily roll back a Trump administration funding freeze on foreign assistance.

I find it abhorrent that prog judges are allowed to prevent Trump/DOGE from trying to stop the fiscal implosion of the US. **** it, load up on food, medicine, and ammo and let the whole damn thing burn down.

Seems like we should cut out the middle man and just make progressive judges the collective Executive Branch.

A lot of what Trump is doing right now is a trap for liberal judges.

Not only will he succeed on appeal all the way to SCOTUS, but in the process he will (1) greatly shift budgetary power from congressional branch to executive branch and (2) create the cases necessary to eliminate nationally applied rulings by lower district courts.

That second one has been the desired target for Justice Thomas for some time now.

Probably time for AG Bondi to step up to the plate and let everyone know that a district Fed Judge does not have the authority to override the President of the US, at least without stating case law and or Constitutional grounds for overriding the President. Hurting peoples feeling and or pocketbook is not a grounds for this crap.

Just subject it to typical pre-Trump govt "efficiency" and speed. The funds would still be here a decade from now.

This.

We all need to take a deep breath and relax. Trump's team solid top to bottom. GOP (for the most part is behind him). His agenda is what the American majority voted for.

The next four years is not just about America First. It's about dismantling decades of leftist swamp corruption and creep and setting it back decades to come. They will get power again.

Be patient. We're going to take a lot of arrows and worse. It is so worth it. Especially if you have kids and want an actual future for them in this country.

Stand on the gas Trump!

Especially when it comes to foreign policy, the executive has a wide, wide, basically total authority constitutionally.

Of course, that assumes the constitution matters to any such analysis, which to Biden/Obama judges is certainly not the case. Mandamus!

So basically these federal judges have taken executive powers from the Executive branch... now have budgets, human resources?

Where in the Constitution does it specify that the federal judiciary can do this?

Unbelievable.

All DC judges should recuse themselves for obvious conflicts of interests.

Funding the government, though, is a Congressional power under the Constitution. If Congress has appropriated $XX billion for foreign aid, with no other specifications, the President can eliminate funding from Colombian Trans Operas and spend all $XX billion for mosquito nets in Africa. What he can't do is cancel all foreign aid immediately, especially where legally executed contracts have been signed.

The way to do this to take the courts out of the equation would be for Musk to make his list of everything that ought to be canceled and the President should send a rescission request to Congress asking them to cancel the funding. That has the added benefit of either making the Democrats vote for the crap or admit it's wasteful.

That sounds great except half the battle is unwinding exactly where the money is going. A lot of this has vague or no explanation of the intended purpose and flows through NGOs that have no interest whatsoever in being transparent. This is a money laundering operation and is vague and complex by design.

The more Americans are exposed to just how corrupt the entire Democrat party is, that may be awhile and we might have a lot of this fixed by then.

As far as the legality of it, after 4 years of a vegetative figurehead and the insanity of the Dems, I really don't care, Margaret. This **** needs to stop. The Dems ignored the rule of law for years. **** 'em and feed 'em fishheads.

This "precedent" of federal district judges claiming to have authority to injunct or order changes on a national jurisdiction basis for the federal government dates only back to the 1960's and actually has a fairly weak foundation of legitimacy, insofar as it hasn't really been challenged formally and formally ensconced into jurisprudence. It seems to have sort of just been accepted as valid without formal endorsement or foundation, possibly because nobody wants to kick out the weak foundation and risk all that has been done by such an authority claim to come falling down.

At some point, it undermines the legitimate constitutional powers of the other branches if used in excess and needs to be formally limited or given legal boundaries.

Here we have a Federal Judge, Amir Hatem Mahdy Ali , who "might' have a conflict of interest in restoring aid to ME organizations. Accord to bio he is Canadian-American. Has been on the federal D. C. bench since November 2024. Apparently another Biden DEI hire.

Completely agree that's a big and significant risk.

Where I hope it lands is Congress controlling the cap on budgets and funding levels, but the executive branch ends up with much more power to not spend it all.

That's how you ensure a responsive and limited opportunity for all this government grift over time and across political swings

they should not even listen to anything the lower courts are doing.

I don't think the low level district court can actually enforce the Executive Branch to begin spending money!
