Hold them in jail or a detention center. Give them "notice and an opportunity to be heard" (as Alito and Thomas agree). If they can't prove they aren't subject to Trump's Order, then adios and vaya con Dios mofos!

Just like if an illegal is accused of shoplifting, they are entitled to a trial. They can't be summarily executed.

It's not a hard concept. Illegal aliens get due process in deportation proceedings. All 9 SCOTUS justices agree, the Trump administration in their briefs agree. But you keep fighting that internet battle!

One thing I think many don't understand is that just because someone is entitled to "due process" that does not mean the same process for every situation is due!


Notice and an opportunity to be heard on why the EO does not apply to them. That's it.

Well, technically, the guy in El Salvador already had his due process when the immigration judge and appeals judge ruled he was eligible to be deported.

The only actual due process left is to move him out of El Salvador (but not to the US) or have another immigration judge remove his Withdrawal of Removal and send him right back.

Could they do a Zoom meeting on the latter?

Exactly.

We seem to have some (regular) folks commenting here that just want to do so for dramatic effect/attention, imho, despite clear legal developments etc. Not sure why, but it seems silly. I fully expect SCOTUS to set this aside tomorrow per above.

They're not gonna do something absurd like toss AEA now, absent jurisdiction etc.

And he's right. Biggest question to me is if scotus vacates this issue today or tomorrow right now. Moving forward with it at their level at this time is insane, as is blocking TdA deportations. Only a few simple (non-legalese) sentences in the notices matter, and those can easily be confirmed in Spanish or the native languages if required.

Heck, the DoJ or CBP can read them aloud on camera to the gang members if needed. "There, we told them."

So the defenders of gangs want due process in the open for the gang members but also want their process for requesting involvement from the judiciary to be done via "unofficial" back channels hidden from the public. Awesome.

One thing that unites most Americans is fighting against things being done behind closed doors. Like the Schiff SCIFs from Trump Impeachment v1 this will ultimately blow up in the Dems faces.

Their current behavior should be encouraged.
