Do people that are here illegally have rights to due process, other than to confirm they are illegals?
I hate tu. It's in my blood.

But, didn't those illegals have their day in court? That is the difference that seems to have people all worked up. That and the fact that many of the illegal immigrants are being sent to prison in El Salvador instead of whatever country they originated from.TexAgs91 said:MagnumLoad said:

This was already answered by previous admins, like Clinton, Bush, Obama. No. Illegals had no rights. They weren't citizens. They were just deported.
Why is this a issue now? TDS?
If they are here illegally, they did something bad enough to get sent back to wherever they left.FloridaAgg said:
"Due process" is not here to protect illegals any more than it's here to protect serial killers. It's here to protect everybody else. If people came with signs telling you all the crimes they committed, it would be easy. Due process is to make sure some innocent guy doesn't get sent away for life cause some post on Facebook or made up story on a news channel suggests they did something bad.
I eluded to this in another thread. I guarantee the border sectors of CBP do not hold illegals for months awaiting trial. They're tried quickly, sentenced to leave, and herded on a bus when they have a full load in a day or two.Maroon Dawn said:
The only due process they should get is a judge sees the evidence that the Fed gives them which honestly only needs to amount to you illegally crossed the border and therefore are being deported. Should take 5 minutes.
Dems want every single one of them to get a year long jury trial to tie up the system and prevent mass deportations to keep their illegals here

I've asked a couple of lawyers at work and some friends from church who are lawyers and they've all said that the U.S. Constitution requires any person in the United States to be given due process. Doesn't matter if you are a citizen or an illegal immigrant.
I assume that is what has caused the hold up all of these years regarding immigration. Not enough immigration lawyers, immigration judges, immigration courts.
That's not what happened. 75% of the illegals deported under Obama did not have their day in court and were processed by the Dept of Homeland Security.murphyag said:But, didn't those illegals have their day in court? the leftists here that were cheering on Dementia Joe's administration suing the state of texas for putting down concertina wire to prevent illegals from crossing the border have new marching orders...and that is to tie up the legal system indefinitely to get rid of these freeloading, criminal wastes of space.American Hardwood said:
Can someone explain to me how being picked up, detained briefly while to determine whether they are here legally or not, and then deported if determined they are here illegally is not due process? Having a border patrol agent pick somebody up, not bother to check their status and toss them back over the border themselves would be lacking due process, but that isn't what we do.
But, I'm sure the lawyers here will tell me that's an oversimplification because if there is one thing lawyers do well, it's making simple things murky and complex. Job security and all.

Where did you find the information about 75% of illegals deported by Obama didn't have due process/their day in court? I'd like to show it to the lawyers I mentioned in my earlier comment.
Quote:
One of MPI's principal findings is that the deportation system has dramatically changed over the past 19 years moving from a judicial system prior to 1996, where the vast majority of people facing deportation had immigration court hearings, to a system today of nonjudicial removals, where 75 percent of people removed do not see a judge before being expelled from the U.S.

For the longest time most were simply given a date in the future that they needed to be in court. Not surprisingly, a rather large percentage of these court appointments were not attended by the illegal that was to be on trial.B-1 83 said:I eluded to this in another thread. Trump and Co. need to establish a "special" immigration court or two with 18 judges going 24/7 6 days a week. Establish who the perp is, whether he crossed illegally, and if he has a previous record or gang affiliation. That determines whether he goes home or to the special place in El Salvador.
