Cameras in the court will be up to the judge discretion in Utah. There have been a few other high-profile cases there in the last few years. All of them have had cameras in the courtroom in some form or fashion.

  • The murder was committed during the act of unlawfully assuming control of any aircraft, train, or other public conveyance by use of threats or force with intent to obtain any valuable consideration for the release of the public conveyance or any passenger, crew member, or any other person aboard, or to direct the route or movement of the public conveyance or otherwise exert control over the public conveyance;

Up to the judge. In the high-profile Richins murder case the judge is allowing for delayed release of the recorded videos. Hopefully that's what happens here.

There is concern about disruption during live broadcast.

Wait, reading that again it is possible there is a designated media pool feed sent out to the press. They don't want the public joining the WebX feed due to disruption. We will hopefully get to see it.

I'll also add that there have been some really bizarre and ugly politics in Utah County the past three years. The current sheriff was caught conspiring with an alleged (now convicted) serial raypist to smear the prior District Attorney. They basically accused him of, well, acts that make Tyler Robinson look like a saint. And the tactic worked because the smear campaign caused him to lose the primary election. The past DA was anti-death penalty, wanted to end all the plea deals, and made enemies with sheriff's office in the process.

Uncivil Law (attorney commentator) on Youtube thinks this could be a Nicholas Cruz situation - eventually plead guilty to the murder and make the state convince a jury to put you to death in a punishment trial. It worked out for Cruz.

Unless Kirk's family pushes for LWOP I don't see the state ever dropping the DP. I don't know what Kirk's position was on the DP.

I could see a defense strategy around being radicalized by internet, so much has been made of how these algorithms and the access of the cesspools allow so much hate to be propagated. The defense will put the internet on trial, can totally see this.

Tyler supposedly said he would rather die/suicide than go to prison. If thats really the case, he can simply accept death penalty.

My guess is he gets word of all the lunatics supporting him and goes for a life in prison reading leftist love letters.

If trial goes to SLC bet he gets a hung jury at which point they will have to retry him. Don't doubt the commitment to the cause comrade.

Well, even if he accepts the death penalty in spirit, he still gets a jury trial and every appeal that would be afforded to anyone else. There's a lot of things he can waive, but they still have to go through the motions.

I think there's a pretty good chance. He will eventually take a deal for life in prison. I guess we will see.

"The internet made me do it" is not a legal defense for murder. Maybe mitigation in a penalty phase but that would be a stretch. They might put a psych person on in penalty phase to tell the jury about whatever mental issues he has and his ability to be easily influenced by others as some sort of mitigation.

Any sort of psychiatric defense for the guilt phase would have to meet a very high bar. It can't just be "oh I'm dumb and a little crazy and the internet convinced me to hate someone..."

To be found not guilty for reason of insanity it's more like "this soda can over here is singing the Battle Hymn of the Republic while the leprechaun chased me through the woods and I shot at it when it sat down under the rainbow because it was going to kill my pet lizard...what's the big deal? Can I go home now?"

I think this was the information.

The only thing the prosecutor said was what was filed with the court to support the charges. As a public court filing it would have been public information anyway. I doubt there will be many more press conferences.

Would be shocked if defense didn't ask for gag order, pronto.

I missed the beginning of it...is it confirmed that the state will appoint counsel for him? Family isn't going to help fund a defense for him?
