https://nypost.com/2025/12/18/us-news/trump-to-deliver-pot-reform-dream-but-rescheduling-stops-short-of-full-legalization/

Basically Trump signed an order to move it to a Schedule III drug. It does not legalize it but paves the way for medical use.

Though I expect beurocratic delays and regional fights, I hope in the next year this removes employers ability to fire for testing positive for THC as long as you have a valid prescription. This doesn't mean an employee can get high or be high at work - same as alcohol. I also suspect Texas will continue to be very stringent.

Finally, a president does something to bring some common sense to this situation.

Rescheduled to schedule 3.

It'll allow for official studies and research without it being the same as heroin.

I'd suspect that in another couple years it'll be legalized federally

1) The biggest implication is that federal taxes on grow and dispense operations go down from something like 70% to something like 35%. That is HUGE! Grow operation owners that are somehow still in business just got rich. Those impacts start now.

AI says:
Quote:

Key Tax Implications
  • Elimination of Section 280E: Currently, Section 280E of the Internal Revenue Code prohibits businesses trafficking in Schedule I or II substances from deducting ordinary and necessary business expenses (like rent, payroll, marketing, and administrative costs) from their gross income. They can only deduct the "cost of goods sold" (COGS).
  • Ability to Deduct Expenses: If rescheduled to Schedule III or lower, cannabis businesses would no longer be subject to 280E and could deduct normal operating expenses, just like any other industry.
  • Lower Effective Tax Rates: This change would reduce effective tax rates that currently can exceed 70-80% for some operators, bringing them closer to the standard corporate rate and significantly improving net income and cash flow.
  • Increased Access to Tax Credits: Businesses could take advantage of various federal tax credits and benefits previously unavailable, such as:
    • Research and development (R&D) credits.
    • Energy credits for investing in efficient facilities.
    • Work Opportunity Tax Credits (WOTC) for hiring from specific targeted groups.
    • Bonus depreciation on fixed assets.

2) I am a solid employment-at-will guy. If your employer wants to be able to fire you for using THC, he should be able to. Period. Especially if the policy says so.

A corollary example is concealed carry. An employer cannot legally ban you from carrying your gun without the proper signage. The employer can also fire you immediately if you carry to work. That is fine by me.

3) Dropping Weed to Schedule III is a great split-the-baby compromise. It will make THC a lot more available without really legalizing it. I agree that it is common sense reform.

4) Too much weed makes you stupid. Don't do that. Especially don't let people under 25 do that. If you want to enjoy responsibly in your own home, that is 100% your business, but, it's not correct to say that using weed doesn't come with costs.

If yall saw the signing in the oval office, it was pretty funny. There were definitely different people with different interests for different groups present for the signing but all seemed content. Trump was adamant that he wouldn't touch it though

Yep, doesn't do anything. It was worth a chuckle to hear him advocating this change and how people he has known needing to use it but still making it clear he wouldn't touch it

you mean the people that were already breaking the law?

Yeah, this isn't for them. It's for people that haven't been able to actually use it medically.

I think you are partially right and partially wrong.

You cannot prohibit someone from using a legally prescribed drug. Doctors will now be able to prescribe it. You can prohibit someone from being under the influence of a legally prescribed drug at work. For example, you can use hydrocodone, but if you use at work, you can be fired.

The "costs" of smoking a little weed is massively less than the costs of having a couple drinks. Everything about alcohol is more hardcore than marijuana.

Anyone who acts like weed is worse than alcohol immediately loses all credibility.

This.

Also, using a dry-herb vaporizer drastically cuts down on the smell for others and cuts down on a lot of the combustion toxins you get from smoking/burning the herb.

If you know what a Schedule 1 drug smells like, perhaps keeping it improperly at "Schedule 1" wasn't doing much in the first place.

Yeah, this isn't for them. It's for people that haven't been able to actually use it medically.

And the overwhelming majority of the medical use is through gummies or edibles, because the medical community generally frowns on smoking anything as it is.

It's funny how all the w33d subreddits just can't say anything positive about this.

Why do potheads think that they have a constitutional right to do drugs?

No, this will not prevent employers from firing people who use drugs.

I usually like to play "whatabout" with these. I'll look up some alcohol related, nsfL car crash pictures. Then we can discuss scrambled eggs.

Not directed at you, of course. That picture always gives me a chuckle.

Congress still needs to undue what they did in the recent legislation reopening the government. Even with rescheduling the federal government will effectively make criminals out of millions that currently use hemp-derived products allowed by the 2018 Farm Bill.

No worries. If the Dems sweep the House in the midterms, gridlock will ensure the status quo remains in place for years.

Not sure if we're on the same wavelength. What I'm saying is the GOP snuck a rider into the not-so-clean bill reopening the government that effectively shuts the Farm Bill loophole. They gave it a 1 year hold on its implementation. So, at some point in the next year, the status quo becomes making criminals out of millions.

Yes. You should pray the Dems don't take over the House.
