So great from Alito!

#4 and final today is Trump v. Miot & Mullin v. Doe

6-3 by Justice Alito

Commie girl squad dissents
Quote:

Whether the Trump administration can end the Temporary Protected Status program for Haitian nationals (Miot) and Syrian nationals (Mullin).

The court holds that the Syrian and Haitian nationals are not "entitled to orders postponing the terminations during litigation."

The Supreme Court first holds that courts cannot review the Haitian and Syrian nationals' non-constitutional claims, because the TPS statute bars judicial review.

The court next holds that the Haitian nationals' constitutional claim, that the decision to terminate TPS status for Haiti was based on racial discrimination, "will likely fail."

What are the dissents based on for this and the asylum case? Feelz?

I don't have time to read the dissent, but I'm sure its likely of feelz and some "muh, racism" thrown in.

Yep...just perused it a bit. The "muh racism" was there.

They conclude that a bunch of statements like "****hole countries" etc were inherently racist...

Seems pretty racist to me to think only blacks live in ****hole countries...

That's why they were pissed when he took South Africans.

First today is Monsanto v. Durnell.

7-2 by Justice Kavanaugh

Jackson dissents, joined by Gorsuch

Quote:

This is a case about whether a federal law the Federal Insecticide, Fungicide, and Rodenticide Act that regulates the use, sale, and labeling of pesticides bars a lawsuit against Monsanto, the maker of Roundup weedkiller, for failing to include a warning on the label about the risks of cancer. The EPA did not require Monsanto to include such a warning, and the agency has said that the active ingredient in Roundup, glyphosate, does NOT cause cancer.

The court holds that FIFRA preempts (that is, trumps) Durnell's claim under state law.

The court reverses the ruling by the Missouri Court of Appeals for Durnell and sends the case back to the lower court for "further proceedings not inconsistent with this opinion."

Justice Thomas has a concurring opinion "to call attention to some of the underlying constitutional infirmities" in FIFRA.

Good for Monsanto/Bayer. The RoundUp witch hunt has to end.

Gee, does that mean the British law applies here in the US because the 13 colonies had to follow their law 250 years ago?
You can turn off signatures, btw

Whoever is (behind the curtain) writing every single thing she says or "writes", needs to pull back a little. She can play the role of DEI 2000% idiot without any more help.
I don't think you know me.

Refreshing to see a judge/justice actually believe in the Constitution.

Great WSJ opinion article on the persistence of Thomas to move the 2nd Amendment from the status of a 'disfavored Constitutional right' to being supported by the numerous rulings impacting the 2A starting with Heller, followed by 12 years of near silence by the SCOTUS, through Wolford.

The article credits Thomas' persistence even in dissenting opinions to gradually move the SCOTUS to where we landed yesterday with Wolford

Few people have been more consequential to saving our 1st and 2nd amendment rights over the last 100 years. God bless this man.
