Even if they do win in court because the tax cannot be zero invalidating registration requirements, that does not repeal the NFA. Will those court victories withstand a Democrat congress resurrecting the tax (likely increasing it to a level that is unaffordable)? I don't know, guess it depends on the lawsuit and ruling, but I think there's a good chance it will only last while the tax is set at zero.

The NFA needs to be thrown out by SCOTUS for being the unconstitutional pile of garbage that it is. The tax was never legal and especially the refusal to collect the tax for me machine guns.

If they tried to reinstate it I would assume any suppressors or guns sold before then would be exempt as there would exist a window where they would have to be grandfathered in.

SEC. 70436. REDUCTION OF TRANSFER AND MANUFACTURING TAXES FOR CERTAIN DEVICES
(a) TRANSFER TAX. Section 5811(a) is amended to read as follows:
"(a) RATE. There shall be levied, collected, and paid on firearms transferred a tax at the rate of
"(1) $200 for each firearm transferred in the case of a machinegun or a destructive device, and
"(2) $0 for any firearm transferred which is not described in paragraph (1).".
(b) MAKING TAX. Section 5821(a) is amended to read as follows:
"(a) RATE. There shall be levied, collected, and paid upon the making of a firearm a tax at the rate of
"(1) $200 for each firearm made in the case of a machinegun or a destructive device, and
"(2) $0 for any firearm made which is not described in paragraph (1).".
(c) CONFORMING AMENDMENT. Section 4182(a) is amended by adding at the end the following: "For purposes of the preceding sentence, any firearm described in section 5811(a)(2) shall be deemed to be a firearm on which the tax provided by section 5811 has been paid."
(d) EFFECTIVE DATE. The amendments made by this section shall apply to calendar quarters beginning more than 90 days after the date of the enactment of this Act.

Valid. I don't have a need for anymore suppressors at this moment so anything I get will be just cause and don't mind waiting.

Probably a new dedicated 9 can, maybe a 5.56 one and something else.

Many dealers are now offering to hold cans after purchase and wait on form 4 certification until Jan. 1 (likely to keep business going until then). The tsunami of e-form 4's come Jan. 1 is already building.

So I just bought a can on Saturday via form 4 trust. Today, two business days later, it's approved. I'm shocked. To me it is totally worth 200 bucks right now to not wait at all. I'm floored.
