Court records show an entity called the Jerimiah Counsel Corporation sued Ed Young, Ben Young, Lee Maxcy (assistant pastor), Dennis Brewer (Ed Young Jr.'s church lawyer and fixer) and the Second Baptist Church Corporation.

Causes of action asserted in the petition are (i) declaratory judgment, (ii) conspiracy, (iii) conversion, and (iv) violations of the Texas Business Org. Code.

Should be fun to watch play out.

Auf English, bitte?
Non-lawyer talk: Ed Young Senior conspired with Ben Young, Ed Young Jr's personal lawyer/fixer, and another SB pastor to strip voting rights of Second Baptist members and vest all power to control all decisions of the church, including related to hiring, firing, church finances, and disposition of assets/real estate, into the hands of Ben Young and a small cabal of Young-selected leaders.

The attorney/client privilege element with Dennis Brewer could be interesting....

The ecclesiastical abstention doctrine is pretty strong in Texas state and federal courts. I expect an uphill battle for Plaintiff.

Lawyers get more/easier access to District Court filings than the general public. The District Clerk recognizes you by your bar card.

Fair...but that's an issue for summary judgment at the earliest.

This case is also in front of a judge who likely has no idea what any of those words mean.

Think he's been involved with Second Baptist for a long time. Half the people that eat at ToT seem to be parishioners.

Reviewing the petition, it's much more personal and salacious than I was expecting. Bringing up Ed Young Jr., ascribing profit motives to Ed Young Sr., etc.

The proper procedural mechanism is a plea to the jurisdiction, not summary judgment motion. If denied, mandamus relief is available.

I thought the same. The shade thrown at Ed Young Jr…..who isn't even a party to the suit was hilarious.

Correct. Was surprised to see that the suit is not being brought by an individual member.

The way that they changed the bylaws and voting rights of church members that have been in place for almost 100 years is CRAZY.

Pretty nefarious how they preyed on the legitimate fears of their congregation about wokeism taking over to instead institute a nepotism takeover. The way to keep the wokeism out is maintain sound doctrine and police your membership rolls, not surrender congregational governance.

Crazy that there was no pastoral search committee also. Comparing to Houston's First after Dr. John Bisagno retired, Houston's First had a 5-year pastor search before landing on Pastor Gregg Matte.

Installing Ben was always the plan. Had been for more than a decade.

His own divorce is at odds with scripture/prior bylays.

Yes. Click on the "Images" tab on the far right and the first file, 120040565, is the one you want to read. I have it saved if you want to PM me an e-mail address.

I'm still really surprised the suit was brought by this group as opposed to induvial members of the church. From a legal perspective this seems like a standing issue that could get the case booted on plea to the jurisdiction brought by SB. If that happens, there could be some serious statue of limitations issues.
