Wow. Amazing. For such a "smart" guy, he makes some really dumb mistakes. "Killed them all of course." Check that mic Bob.

Hopefully, they find and arrest anyone who helped him or covered for him. Just amazing.

I enjoyed how they made the juror from Galveston look like an idiot.

Btw, when he was arrested this weekend, he had a fake passport, large amount of cash, and it was his first day in NO which coincides with the first flights to Cuba from there in 50 years beginning yesterday.

I read an article, couldn't find to post but it said that everything that aired will be admissible in court or the trial. Should be very interesting to see how all this plays out.
What was he arrested for in NOLA? Murder?

1st degree murder for Susan Berman (Warrant out of LA)

There will be a battle about the hot mic as far as expectation of privacy (alone in a bathroom) and also proving it's him and not tampered with. The amount of time it took them to discover it may also raise some issues toward validating it. So admissable in theory but very vulnerable to being tossed.

That was one of the most shocking finales to a series I've ever seen. Absolutely cannot believed it delivered on that level. Just amazing.

Shocking finale, but NEVER count out Dick Deguerin. The LA district attorney's office doesn't have the greatest track record in high profile cases.

Will be interesting to be sure. Though shocking, I don't think his bathroom comments are a slam dunk to make it in to evidence, and even if they did make it in to court, I can see them being explained away by the defense, as Bob saying to himself what other people will say (you're caught. arrest him. I want this, etc).

Oh and don't get me wrong. I think he killed all 3 people and should be in jail, but just hoping the LA investigators have more than the letter and interview tapes.

Comments in the bathroom are 100% admissible. Voluntary interview he knew was being taped. There are no state actors (police) so no Miranda, custodial interrogation, etc.

What won't help is that I think the filmmakers are shady. I don't buy for one instant that they didn't realize they had that audio for 2 years. I think they sat on it waiting for their big moment.

Also, if he was in the bathroom by himself using it for its intended purpose - which he seems to have been, then he's at least got a shot at it being tossed under reasonable expecTion of privacy. He agreed to an interview in a conference room, not to be inadvertently recorded while alone in a bathroom.

He has a fake passport and lots of cash when he was arrested. That plus the letter will be enough for a trial. Those recordings are admissible, but even if they weren't it should be enough. However, admitting to cutting up the body after "self-defense" should have been enough too. Galveston can't do anything right.

I'm sure the handwriting is fair game. But based on the articles, it sounds like that wasn't exactly new news to the investigation - that they've tried to link it to him before. Right now they have him with a possible motive, in California, and with maybe a handwriting match. Start of a case but to get to beyond reasonable doubt against a high powered defense team will be tough unless there is more.

I would think there will be dozens of factors to consider when making an admissibility determination including audio recording laws in the state the interview was conducted in (NY?), was there editing done, chain of custody of recording, California rules of evidence, etc. Not sure anyone can make a determination at this point having just watched it unfold on TV as to whether it is or is not going to be admissible.

I am sure the prosecution will have an expert that says so. The defense will have an expert that says the opposite.

Agree, which is why I'm saying he at least has a chance of it being tossed vs making a definitive claim of it being admissable (or not)

What we know so far is that there are some evidence that would help prosecute him but each also has plenty of angles for a defense team to attack.

There is always a chance. Obviously. Putting qualifiers on everything is why people hate talking to lawyers. I would bet money the tape comes in. How's that?

What took so long to get the documentary aired? The original movie bombed big-time. All of the work we've been watching was recorded a few years ago, right? Seems like that's the next place his attorneys attack regarding the tape. Did they fabricate anything to close the deal on getting this documentary picked up and publicized?

I was very curious as to what may have been in the backpack when he went to his brother's. I'd be scared as anything if I thought this guy was motivated to kill me.

I thought it odd that they didn't include the recent charge of peeing on the candy at a convenience store checkout counter. Guy is obviously deranged.

That was incredible television. We rewatched the final scene a few times and the body language is fascinating. Jareki couldn't look Bob in the eye and his hands were shaking when he held up the handwriting example. I can't imagine how terrifying it would be to confront a murderer with evidence that could potentially put him away.

It's truly remarkable to see something like that on film.

If DeGuerin can practice law in CA and Bob gives him the nod it should be an easier rap to beat than Galveston was, assuming there is no more evidence than the letter and the second interview. A good lawyer can cast enough reasonable doubt on that evidence to blow them out of the water.

yeah, a good defense should be able to shoot plenty of doubt into what they have so far. but at this point, so much has piled up across all 3 cases that he may finally run into a jury that would have the attitude most of us have - this nutjob is as guilty as sin and it's past time someone does something about it.

The letter where they can show the mispelling and put some of the exact words side-by-side does provide a wow factor for a jury that a simple handwriting comparison does not. And if the bathroom portion of the interview goes in, that would be huge.

But this is a guy that chopped someone up and was found not guilty. They almost need to count on a boomerang from that, where the next jury swings the other way.

If the defense can use the NY DA in the Galveston case then the CA DA should be able to use whatever they want to paint a picture of a mad man.
