Most likely because unlike foreigners, Americans will lose everything and go to prison if they break the law where the government will use every available resource to drop the hammer on them.

You've just described a tyrannical government. We all know, deep down, that we've been living under tyrannical rule for several decades. It's a soft tyranny, currently. Citizens stop paying taxes en masse and you'll see a turn to hard tyranny.
