In her earlier decision, Judge Immergut held that the only relevant time period on the question of whether the President is "unable" to enforce federal law is in the days immediately preceding the deployment order.

The Judge is going to make a factual finding that the situation on the ground at this point is such that no National Guard forces are necessary because DHS/ICE are able to carry out their operations. She might even ask direct questions of DHS/ICE witnesses on that subject herself.

This is why the Oregon/Portland officials moved when they did, and this is why Antifa cooperated. It set up this very scenario, in anticipation that the Ninth Circuit's en banc order was going to clear the way for the District Judge to make a record for appeal that will be more difficult for the Administration to overcome.
