Jurisdiction did not attach for a habeas filing (which is specific to the actual custodian holding a person) at the time of the filing. Change of venue required to the current actual custodian, which is Louisiana.

That area is "open to the public". We went several times over Thanksgiving (so after election) and there were NYPD offices at the entrances, but they were more profiling and keeping you from bringing in suspicious packages and such.

Deputy Mayor said that these agitators arrived separately with coats concealing their red protest shirts. They then assembled and were asked to leave same as if you were asked to leave a store or restaurant or shopping mall.

The other areas of Trump Tower are off limits.

Looks like he flew out of JFK to Alexandria, Louisiana. I don't think that's a big deal, but it's sort of comical how desperate the Hamas legal team is to have this all get heard in the SDNY.

So, in order, here are a list of things I expect to happen over the new few months with predicted outcomes:

  • Louisiana judge will deny him bail, and he will remain in detention pending the outcome of all deportation proceedings.
  • Order of Deportation will be entered by Immigration Judge.
  • BIA will deny his appeal of Order of Deportation.
  • Fifth Circuit Court of Appeal will deny appeal of BIA decision.
  • A new petition for writ of habeas corpus will be filed challenging constitutionality of INA provision giving Secretary of State discretion to declare that an alien's continued presence in the US is contrary to US foreign policy.
  • [/ol]The Trump Administration is likely to follow on with deportations of protesters who are holders only of Student Visas, and allow Khalil's case to be the only "test" case on the use of the Secretary of State's authority to deport a permanent resident alien.

    Everyone knows lawfare judge shops to get the best chance of getting a liberal sympathetic judge. Well now Trump is doing the same, at least with deportation matters.

    Set up a deportation center in LA as the judges are appointed by Republican presidents.

    I read the government's motion to dismiss and the amended petition, and I'm a bit confused by something. Khalil's attorneys are saying the petition was filed in SDNY because the ICE locator had him listed as being in New York. The petition claims that at 10pm on Saturday night, he wasn't in the locator, but then at 1:35am, 4:29am, and 8:30am on Sunday, he was listed as in New York, and it was updated sometime after 9am to show him in New Jersey. The government's motion says that the ICE website hadn't been updated with accurate information at 4am on a weekend morning, but he had been moved to New Jersey prior to then.

    Now, what's confusing to me is that DHS was able to update the locator sometime between 10pm and 1:35am, but then they weren't able to update it from 2:20am/3:30am (the time the government says he was booked into the New Jersey facility) until after 9am. So, are they able to update the ICE locator overnight on a weekend or not? It just seems odd that they were able to update it at one point, but then not at another point.

    Also, if he was at the New Jersey facility until 11:30am on Sunday, why was his wife told that he wasn't in the system there at 11:20am, but at that same time the ICE locator said he was there.

    The story the government is telling seems to be a bit irregular to me, but that's something that should be easily cleared up at a hearing.
