From what I gather this is just the immigration judge's ruling. The judge in NJ seems to have a burr up his *** about this whole issue. This isn't over by a longshot.

Illegally? Some stupid order to try and hold the Trump admin in contempt for violating an invalid order. There was a very specific reason why the original habeas claim was dropped. No jurisdiction.

Look, I have been out of the biz for quite awhile now nor was I a superlawyer when I was active but a lot of things are just so well settled procedure and law, it is just mind boggling how much these federal district court judges are on very thin ice, if anything at all.

The argument is that as the original claim was filed in NY, it was transferred to NJ because that is where he actually was at that time (for purposes of jurisdiction based on flight records) when the poor Hamas legal team filed it, but they didn't know. The NY lawfare judge wrote something like 60 pages about how NJ was proper. It's not going to stick since the SCOTUS ruling but it is what it is and NJ judge is animated about it.

Yes, it will go no where but I expect another 'judicial opinion' bordering on war and peace length about how mad he is about it.

Technically, they can refer them for investigation for violations of judicial ethics and Cod of Judicial Conduct. But the judiciary is just too clubby to do that one of their members. A tongue lashing in an opinion is about the worst that they would do.

Congress OTOH, besides the Supreme Court, created the federal judiciary. And what Congress creates, they can amend, in particular adding an additional way to remove these judges other than a full blown constitutional impeachment and removal process.

Update, some idiot (D) clerk wrote a 100 page opinion in the Khalil habeas case. It's laughable, as only around a paragraph or two were needed, and the vagueness of the statute shouldn't have even been considered at all.



TLDR: the statute is not vague, the court is legally illiterate. Mahmoud Khalil's motion for a preliminary injunction has been denied. The court found that Khalil is unlikely to succeed in his challenge against the claim that he failed to disclose key information in his green card application, such as his membership in CUAD and former employment by UNRWA.

Judge Farbiarz also said that Khalil is likely to succeed in his challenge that 8 U.S.C. 1227(a)(4)(C), which allows deportation for "compromising a compelling foreign policy interest", is unconstitutionally vague, but did not grant an injunction yet, said more to follow basically.
