for those who have gone through the process of converting an AR pistol to an SBR, did you do that through a trust or as an individual? any benefit to one over the other?

if you did it through a trust, would you create a new one or could i use the one i created for my suppressor?

I have SBRs and Supressors on the same trust. My understanding is that trust are better because the people you put on the trust can posses the items without you being present. I'm sure there are more benefits but that's a big one.
Trusts aren't terminal with the life of an individual. If you die, anything you own individually theoretically doesn't become your kids'. In a trust, it can. Consult with an attorney or EyeGuy.

Very likely depends on your trust.

I used Jim Willi to create a trust for all of my NFA items. If your trust is specific to a certain item, you may need an amendment or an additional trust.

If I were you, I'd consult an attorney that is experienced with NFA trusts.

Bumping an old thread. I just got an email stating that Form 4 Eforms expected to be back sometime before the new year, and the wait times are expected to be less than 90 days. Anybody else hearing/seeing the same thing?

Yes, but I think that its the expectation that this will get wait times down that low. I suspect they have to get through a backlog before that might be a reality.

In my memory, ATF eForms will go live and only process transactions from that point forward, not in a FIFO basis with old forms.

So my understanding is that there will be people submitting through eForms that get their stamps before some of us that put paper forms in months ago.

I hope they get thru the backlog before they start these. I'm at 324 days right now since my first can. Have a few spaced out between that one and now. Ugh.

Yeah I've got one that should be close to getting finished. This better not make me wait longer.

Thats my understanding as well. Makes me wonder if somehow I can redo my paperwork to a eform since I only bought it a couple of weeks ago.

I'm in the same boat. Bought two through silencer shop last week. Going to suck balls if it takes me a year to get approved while everyone else that bought after me getting them in 3 months.

SilencerShop said the feds will make you wait a year if you cancel the paper form and come back electronically.

They can hire 70K new IRS agents to harass small business owners, but won't hire the additional ATF/FBI personnel needed to speed up NFA processing. This is just so incredibly ridiculous for a product that does nothing more than protect your hearing!

Mine took about 6-7 months but there was a discrepancy on the trust form (parties involved) that was eventually resolved despite no help from the ATF.

Went to a gun store with a Silencer Shop kiosk last week to start the transfer on a suppressor I won. The dealer couldn't get my information to submit correctly to Silencer Shop, I think they had taken the dealer portal down in anticipation of this announcement. He said it was working just the day before.

2 days later I get the e-mail from Silencer Shop about the Form 4 e-file. Signed my docs electronically on Tuesday through Silencer Shop's website. Under my documents it says "You are currently completing forms via electronic submission." Looks like my Form 4 will be one of the first to go in once it is live. Will keep you updated on wait time.

I am going to be pissed if you get yours before I do. Check cashed in early January 2021 and still nothing.

With that said, I find myself suddenly motivated to go buy another can.

On silencershop portal, my status just changed from awaiting Form 3 approval to Form 4 signatures complete. We had the signature stuff completed, submitted, and approved by their compliance department last week. I'm wondering if they haven't submitted the Form 4s to the ATF yet and if so, they may end up going eform.

I'm about to do a Form 1 for a solvent trap I bought awhile back. We'll see how that goes as well.

Went by my shop last night to pick up some LetsGo-15 lowers. They recommended waiting until the 15th to take advantage of the current SilencerCo deal, as eFile would be up and running by then.

ETA - For a timing reference they had just received their first February 2021 Form 4 stamp back this week. They do about 20 cans/week.

I'm getting pretty pissed but there's no recourse. Next week I will be at one year since my cash was checked and 13 months since actual purchase.

Update.....thanks to this thread I decided to call ATF. Unreal discovery. I was approved 7/28/2021. I have called the dealer three times and each time they looked up my info on their system and it said pending. I called again today after getting off the phone with ATF and they said it still showed pending and they didn't have my stamps. I started writing a letter to ATF for certified copies to be mailed. In the meantime I get a call from the dealer saying that they have all of my stuff, including tax stamp and I can come pick it up. Said they tried to call my cell phone a long time ago but they received a message that phone was not in use. I asked why they wouldn't have told me they had it when I called three times. No explanation. Heading to get my cans out of jail now, but pretty pissed that they've been sitting there for five months without me knowing.

So what could we do now to have everything ready for the 15th if we've never filed before?

Is there an easy to follow guide on this somewhere?

You said easy? Just go to your local shop with a SilencerShop kiosk & follow their advice.

Or did you mean, comprehensive?

Both. Looks like I have a Silencer Shop kiosk near me, sounds like that is easiest path.

Do you need a gun trust for this? Highly recommended or a necessity?
