Here is what the ATF said ~

Thank you for the inquiry. Here is the information that I was able to find for Shalackin:

1. eForm- was received on 01-31-2023. As of 11-15-2023, the application is PENDING with ATF because it is in a DELAYED status with the FBI's National Instant Criminal Background Check System (NICS).

DELAYED status with FBI/NICS could mean that there's an issue in the applicant's record, or something that needs to be corrected or clarified. ATF cannot complete the transfer without a definitive PROCEED from FBI/NICS.

I will use the release form you sent me to inquire to the FBI on your background checks and let you know what I find out.


I got the same response through my rep, they then contacted the FBI who said they had approved it and it wasn't delayed, so then my rep reached back out to the ATF who basically said, sorry we have a backlog

Some Reps are better than others. Even the ones that run on being "conservative" or "Pro 2A", can be less than ideal compared to others. I don't want to name names, but at least one mentioned above is there because of name recognition, not because of talent.

Ideally, you want one that is sitting on the committee for these agencies and has some say so on how much money they get.

Pleasant surprise today. Just randomly logged into my Silencer Shop account and saw my can submitted in August was approved 3 days ago. No eForm email to either me or the dealer, but they confirmed approval and I'm on the way to pick it up. 60 days faster than my Form 1.

You need to call ATF and check. It was surprisingly easy to call them
So the greatest civilization is one where all citizens are equally armed and can only be persuaded, never forced. It removes force from the equation... and that's why carrying a gun is a civilized act.

Wait I logged into their website and was able to see that my cans have been certified but they don't say approved or anything. Makes me realize the app is pointless for anything other than registration.

I had to look under "orders" to find the date I purchased this one. It took a while to find it because it was listed "complete" which I obviously didn't expect. If I look under the "wallet" it still shows this can as "in progress". Glitches everywhere it seems.

Click the eyeball and it should give more info and you can view the timeline for your can. The one complete may be just the purchase of the tax stamp, at least that's what I have showing for some of my orders.

Is this process of checking status only unique to silencer shop? Or are there other means to check like through the online eForms? I haven't gotten a chance to really look through it.

Well how 'bout that. The other eform 1 sbr I submitted a day after the one I mentioned above came in today. So 26 days for this one. I thought it would take several months at least, so I'm happy.

Here is the response we received from the FBI ~


Please be advised of the following based on your constituent's concerns:

The FBI Criminal Justice Information Services (CJIS) Division's National Instant Criminal Background Check System (NICS) Section received and reviewed your request regarding Shalackin. The following information will better assist your constituent.

The NICS Section reviewed Mr. Shalackin's inquiry. Based on name and descriptive data, a background check regarding National Firearms Act (NFA) was finalized by the NICS Section on November 21, 2023. However, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) enforces firearm laws and conducts firearm background checks required for specific regulated firearms pursuant to the NFA.

I will go back to the ATF with this information to make sure they are aware of the FBI update.

I will be in touch.

They'll now say that there is a backlog and they'll get to it when they get to it, after trying to blame it on another organization and then getting called out on their bull*****

Eh, congress has to pass a repeal first.
Better chance of the judiciary ripping it to shreds as they should. They tend to shy away from overturning federal legislation, even if clearly unconstitutional (like the NFA), due to will of the people and all that jazz. Which is BS, because their job should not be influenced by popular opinion or political forces, but that is the reality we live with.

Almost zero chance congress ever repeals it unless there is a major political shift in this country which seems unlikely to happen in the direction of more gun freedom.

I've confirmed that the FBI issued proceed status for Mr. SHalackin's application. The application now awaits final processing with a NFA examiner.

While I cannot provide an exact timeline, Mr. Shalackin should expect to hear back relatively soon. I

I will check in with you in 30 days to see if you have heard from the ATF.

Feb 6, 2023, accepted by NFA, two cans, .22 and a 30 cal. Sunday night (yesterday), 7:00, email arrives stating the e-form is approved...for the .22 can. FFL today said to expect the 2nd approval anywhere from tonight, to 3-4 days.

Called today to ask about my Form 1 that they received on 6/26. Told them my other ones took less than four months. Was told there was a backlog on Form 1's due to all the amnesty Form 1's.

1/27 to 11/11 for another can. and I never got an email. Scheels called and said 'we've had your can for 2 weeks, are you coming to get it?'
