Castle doctrine says retreat is not necessary before engaging in self defense. It does not mean trespass alone is sufficient reason to use deadly force.

Is the correct term "simple trespass"? The mere act of being somewhere you do not belong would not seem to create a justifiable reason.

But if you are committing other acts whilst trespassing then that expands justifiable reason, no?

I am not a lawyer, but I play one on TexAgs from time to time. Genuinely trying to understand if this is the distinction you are drawing.

In Texas, self-defense and castle doctrine extend to the curtilage.

I think the iffy part would be in how that curtilage is defined. And could reasonable be tricky.

I have an open backyard with a covered patio and a detached cabana. I also have full shades on these structures. So… if the shades are up is my adjacent patio curtilage? Maybe? My cabana shades up? Probably not? If shades are all down can I bust a cap in the trespasser?

I'll admit, it's a trickier area than I thought.

Edit to add: curtilage is now in the ftc dictionary, entered right after anti-navelist.
