First, the statute of limitation should have run on this claim long ago. The very idea of pursuing this sort of claim after 30 years is patently ridiculous.

Second, I have serious reservations about the concept of a defamation action arising from the simple denial of allegations made by another person. That is the way the store has been reported, but I have not read the pleadings. I must believe that Trump said something more than simple denial the rape allegations.

Third, you should not win, just because you say something happened. You should win if the jury compares and contrasts your testimony against the testimony from the other side. Sometimes they will believe what you have to say about something that happened several years ago, sometimes they will not. That is rather the purpose of a jury in our civil justice system.

I have a pretty good idea of how "court works."

I have spent some time (not an inordinate amount of time) trying to find a direct quote from the pleadings as to exactly what defamatory statements Trump may have made. They should have been pleaded with specificity, but I cannot find them.

Hes got a major credibility problem on the whole and the access Hollywood tapes speak greatly to his character. I wasn't there, but I'd have a very difficult time merely taking his word over it.

Which she admitted when she testified. She had a book out, it wasn't selling well so she went on a media tour with her allegations about Trump which were contained in 9 pages of her book.

Photograped in the dress she claimed she was wearing that day, in New Yorker magazine. Problem was she claimed the assault happened in 1994, but that dress was not sold until a few years later.

I was just discussing this with my wife, it would have to be against Trump or maybe some other Republican the left hates though. We have a two tiered justice system in this country. Kavanaugh or Gorsuch may be good targets.

Most of this is punitive, which isn't so much about harm to her as much as trying to stop Trump (or someone else) from doing it again to her or anyone else, as well as whether he acted with particular malice.

Every time Trump and Habba tried to relitigate whether he defamed her or essentially repeated the same comments, the jury probably upped the punitive damages. And Trump and Habba did that A LOT.

So this is just a grudge match between the jury and trump over how much they disliked him with the case basically only serving as a gift opportunity to inflict punishment for whatever motivation. Civil law is insane at times.

With this being bifurcated trials, one for liability and a second trial solely on damages (which is fairly unusual for a civil case) created a collateral estoppel as to facts found in the last trial.

So in the damages trial, already hobbled in what can and cannot b admitted, including that the first jury found Carroll credible on a sexual assault but not the rape.
