I did call one in the area but if it's locked behind a gate they can't help without an order or PD assistance in pretty sure.

Perhaps someone here with more legal knowledge than I will shoot this down with good reason, but if the police she'd knows of 6 cases like yours from all over Texas, why doesn't someone involve the Texas Rangers and screw that local DA?

My company will not do business in Hidalgo County. It's practically like doing business in Mexico due to the pervasive corruption. It's baked into both the criminal and civil sides of the coin. I wish you luck.

Yes I have and unfortunately it does not have telematics which is surprising as it is a 2022 model.

Update:

I spoke to the deputy who let me know that he did put in the report and that the serial number is now hot. He is passing up the info to their CID department to see what they will do with it. He did say that it sometimes takes some time and they may ask for additional info. Said that our county DA may take interest in prosecuting especially since their's appears soft on crime.

I did mention that maybe the state departments like the Texas Rangers may be interested for all of the reasons we've mentioned here and he said he would mention that to CID. Just trying to think of the best ways to keep it out of the local county/city's jurisdiction since they won't do anything.

He did tell me that more than likely it will take longer to recover the machine (if at all) than it will take the insurance to just payout, so to just pursue that route through the driver/broker insurance and if it is recovered then the machine will just go to the insurance company.

Honestly, I'd be impressed if he's found little loophole to exploit and play in the gray area between criminal and civil…. I'm dealing with a similar situation, but in food. I have north of 20K worth of product missing since September. First time we have ever delt with anything like this, but apparently pirate trucking is a thing... local PD has been worthless for us. My issue is with the broker that handled the freight, but the broker didn't run it through their company... tried to cut some corners, and now claims no insurance..... it is definitely something that's making us change our policy.

Never had professional interaction with these guys but know three of them personally from when I lived in Bee County.

I know it's not as far south as the Valley and I don't know where they are panhandle wise with respect to you, but they serve both general regions.

You may have to join but it's pretty reasonable. They are a big sponsor of my equipment association ARA.

I have never used them, but this is their specialty.

Know a family with a large construction company and they have trackers on all their equipment. When something is stollen, they go get it. Last time I asked their stolen backhoe had gone to a storage yard in Eagle Pass. They roll up the next day with a truck and trailer, tell the storage yard guy that is their equipment and give him a paper with the vin, make and model. So far, they have always been told that the equipment just appeared overnight and to take it if it's theirs. Not sure if it's because of the shotguns they carry on shoulder slings.

They said dealing with law enforcement in Harris County is a complete waste of time for stolen vehicles and equipment.

One thing many Thebes have learned to do is just this; leaving it in a yard for a couple weeks to see if the owner finds it. If it's there in a couple weeks, then they move it again. Your friend's process works on these.

Others have learned to find and remove or break the telematics and other gps location devices. This is actually more common today. Your friend has been lucky that more experienced thieves have taken his stuff yet.

For sure they have lost and not recovered numerous things over the years. But have learned to fabricate trackers on machine parts. I know we spend too much on equipment theft insurance each year so it's great to see stolen equipment returned in any way. Has to be shocking to the thieves to see the owners show up.

Getting our local DA to prosecute theft cases has been just as frustrating as the theft itself.

Update:
First of all, huge thank you to Centerpole90 for all of your help.

The driver/carrier insurance is unsurprisingly claiming that this is not covered because they are classifying it as "non-delivery". A little googling and it looks like they cover theft but only if it's stolen by a third party, doesn't count if it's the driver/carrier who does it?

Now it will presumably fall to the broker's insurance who I would think will make the same argument and deny the claim.

At this point, the way I see it, it will likely come down to the broker bond, or them paying out of pocket either voluntarily to avoid me filing on their bond, civil suit, legal fees, FMCSA complaint filed etc… or I will have to go to court to sue them.

I feel like I would have a very strong case against them for negligence alone. Just a few things they did or didn't do…

- Didn't check how long they were in business before hiring them (they created this LLC December 15th and just got insurance the 16th).
- Didn't verify that the vehicle and insurance matched.
- Didn't verify that the driver's ID and the driver were the same people.
- Didn't verify that the guy had a carrier/boss, he is just a sole operator (not in itself bad, but paired with the fact it was just started definitely a red flag).
- Didn't pay extra for GPS tracking because it costs more (have this in writing) said they are going to start doing that now.
- The transport LLC was called "Sacurehaul LLC", I feel like misspelling should've been a red flag.
- Also have emails from my broker agent and the owner of the company apologizing for hiring this guy and taking full responsibility for my machine and it's safe delivery.

These are just a few of the bullet points.

1. Roughly how much was the skid steer sold for ?
2. What's the fare a hauler would earn hauling a skid steer from Dallas to the pan handle?
3. The freight or hauling broker … what's his take in this transaction?
4. What cash has exchanged hands at this point?
5. How's your buyer doing?

2. I was paying the broker $750, and they were paying the hauler $500.
3. Apologetic, ashamed it happened, wish they had never hired the guy. Let's go through drivers insurance, then their insurance if that fails.
4. Just me being out the money for the skid steer.
5. He is no longer a factor in this. It's just me, the broker, and hauler.

What is the hauler asking you to pay him directly?

What are the specifics on your arrangement with the broker? Does he take possession of the machine when you contract with him to haul it?
