Someone mentioned a probation officer. Have you considered that approach?

Yes - it appears he is on 5 years of probation. I guess I figured I would let the law enforcement who are on this shake that tree, but I suppose I could as well.

I see now how law enforcement is being evasive about making this a criminal issue. Their rationale is the driver hasn't stolen your equipment. He has just refused to provide the transportation service. That makes it civil.
There has to be a way to go after guy that involves the law. He is in possession of something that doesn't belong to him

Apparently a constable talked to the suspect, the constables misunderstood that the skid steer was stolen, not the trailer, so they went and questioned him about the trailer that was parked there and ran the plates and it didn't come up stolen

You're getting the runaround, big time.

Update:
The constables have confirmed that this guy has been trying to sell it to local rental yards for $7,500 ($45,000 machine). They are trying to track him/the machine down and letting the dealers/rental yards in the area know that that machine and serial number are stolen.

They obviously knew it was stolen if they didn't jump on that. Hopefully we get a happy ending here.

Yes, he is a complete moron for trying to sell it for $7,500.
On one hand I am hopeful because he does not appear to have any theft ring connections to disappear the machine in Mexico over night if he is going around to local dealers/rental places, I just hope we are not too late and he found a buyer. Seems like LE could orchestrate a sting with one of the rental places or dealers to try and catch him selling it.
Either way I would think he is toast, but I want my machine back.

Taking it across the border may have been his backup plan if he couldn't get you to pay him. Getting it into the database as stolen has scuttled that plan because it will get flagged if he tries to move it across. He probably knows he isn't getting paid by you now that it is flagged stolen and just wants to get whatever he can from somebody who isn't too worried about the status.

You can not imagine how hard it is to resist the urge to grab a 6pack of beer, go get RGVAg in the truck with me, and try to get this pendejo on the phone and arrange a viewing.
Unfortunately, that would only mess up the process.

You may be right about that. I am thankful that we have law-enforcement that still take their job seriously and know theft when they see it. The deputy who came to take my statement, spent like four hours with me and multiple phone calls with the thief which just incriminated himself further on a recorded line. Hopefully the machine stays in the US and even if he has sold it, they can take his phone and grab everything off of it to find out where it was sold.
The detective said if they can get his phone that that will be very helpful and a treasure trove of information. I assume that even if he tries to delete everything that they can still retrieve it all.

This is modern-day McMurtry in a TexAgs thread.
I hope it has a happy ending! I'm hopeful for the OP. TexAgs network is wild.
