This is false. Department of Education Organization Act established the Department of Education. Jimmy Carter issued Executive Order 12212 which specifically references the authority vested in him by Congress to begin establishing the department. If you want to eliminate the Department of Education, then it must be eliminated by Congress just as it was created by Congress.
