From my understanding, the VSC stated the referendum election was allowed to proceed but they would not make a decision on the constitutionality until after the election was completed. Sounded like they were going to make their decision based on the results rather than the actual Virginia Constitution. There was no damage or harm until it was passed. That is what caused voters to be disenfranchised, hence the harm. Pretty common for a court to wait for the harm to manifest, in fact.
