Yep, it's clear that this guy was out for "social justice" and not legal justice.
Well it is our system, flawed as it may be. Not all outcomes will meet your standards.aggietony2010 said:Dan 07 said:What an odd responselda6339 said:I did too!!!!!! Hooray!!!!!!!!!wbt5845 said:

Surprising, but probably the correct outcome. You shouldn't be able to walk into someone else's house and kill them.

No. In my opinion, not guilty was the right call, but murder was a close second. I honestly don't think the average person is capable of handling the jury instructions that we're given.
Honestly I think murder with 5 years is the best case for the community as a whole.
Kind of what I was thinking earlier. Murder conviction with a sentence on the light end is probably what should happen.aggietony2010 said:lda6339 said:Are you insinuating the jury was wrong?aggietony2010 said:Dan 07 said:What an odd responselda6339 said:I did too!!!!!! Hooray!!!!!!!!!wbt5845 said:

I dont think a jury of TexAgs posters could have come a 'better' solution. We would have probably become a hung jury because we'd think about it too much. (not saying in this case but) Sometimes the 'average people' know more than a bunch of keyboard jockeys and attorneys like us.aggietony2010 said:lda6339 said:Are you insinuating the jury was wrong?aggietony2010 said:Dan 07 said:What an odd responselda6339 said:I did too!!!!!! I take solace in the fact you have to live your life being the person you are. I couldn't wish anything worse on another human being.

I'm sure to you Botham is just another guy, but I can assure you to me he is not. I'm blown away people here feel more sympathy for a murderer than her victim.Hincemm said:lda6339 said:How is justice shameful?wbt5845 said:I cannot even begin to say what that makes you without certainty I'd be banned.lda6339 said:FIFYwbt5845 said:You weren't sitting 10 feet from the convictedlda6339 said:I did too!!!!!! Nothing to do with justice. Has to do with you acting like a ***** I think

Murder is disgusting, repugnant and reprehensible. It shows a lack of fundamental human decency.

Agree with this. Nobody "wins" in a situation like this.wbt5845 said:
Justice is not. And I think this is the right verdict. I agree she should be punished severely.

If she's my daughter I'd like to think I recognize that at least I can still see her, talk to her, visit her in prison, then when I look across the room and see a mother and father that can't do those things, I realize I will never feel the pain they went through, and that I'm in no position to judge them for their actions.HouseDivided06 said:
Is it not possible to realize it is a tragedy on BOTH sides and be empathetic for BOTH sides on this? I believe her that it was an honest, terrible mistake. You keep looking at it from the Botham Jean side, but using your own emotional appeals, imagine if Amber was your daughter or sister. You believe she made a terrible mistake, thought she was in her apartment, and believed she was acting self defense. Legitimately believed she was in danger and in her own apartment. But yet you want to cheer at her conviction? I see both sides, I see how murder was the verdict, and I also see how she could have walked given this incredibly unique set of circumstances. But to assume Botham Jean was "just another guy" to people who think that the state didn't prove beyond reasonable doubt that her mistake in fact defense was reasonable is obtuse.

How is she not guilty?
The state was supposed to prove that it was unreasonable to think she was in her apartment. As someone who has walked to the wrong door in a similar complex I can believe her claim.
From there they have to prove it wasn't self defense. Which i don't think they did.
The jury found otherwise.
I obviously have no inside knowledge, but one has to imagine the jury will be lenient in sentencing. She didn't hunt down, kill and field dress the guy - she killed him by accident.jeffdjohnson said:
She needed to found guilty of something. Both murder and manslaughter were weird fits given the "mistake of fact" and trying to interpret her intent. I'm not surprised the jury came back with a guilty verdict though, but I would have guessed manslaughter as a compromise. Having said that, the sentencing will be the big thing here. I don't know how many years is appropriate but I think she should have a chance to get out on parole at some point.
