Bo's contention that she didn't receive preferential treatment over what a non-cop would have received immediately after the shooting is ridiculous, but doesn't quite rise up to advocating for vigilante justice.

Sgt Valentine testified that once she found out Guyger was responsible for the shooting, she was supposed to take her to her car and isolate her. But that isn't what happened.

Guyger was allowed to interact socially and hug several other officers. Then she sat in the car. Then the Police Union guy (a superior officer) ordered Sgt Valentine to shut off her car's camera. This violated departmental general orders.

Guyger was allowed to use her phone in the car.

I think it is completely understandable, but she absolutely got preferential treatment because she was an officer. Any argument otherwise is just silly. Sgt. Valentine even testified as such.


She did separate her but then brought the car around and while she was doing that, officers who arrived at the scene tried to comfort Guyger. At that point it was still being treated as an on-duty police shooting. Nothing Valentine or Mata did we're out of the ordinary for an on-duty OIS.

Mata is receiving harassing phone calls and there are protests scheduled today to demand he be fired bc he did his job.

The great irony is that the department went completely away from general orders in an attempt to appear objective and brought the Rangers in to investigate. Sometimes you can't win.

In my opinion, if the defense proved mistake of fact (or actually if the prosecution didn't disprove it), then the castle doctrine would apply. And it wouldn't really matter if other people who went to the wrong apartment had shot anyone. That's why I thought it would be a good idea to focus on mistake of fact so much. In my opinion, according to the law, if the state wasn't able to disprove mistake of fact, she was basically home free because if the castle doctrine. So having a lot of witnesses focus on the mistake of fact would have been beneficial (saying I would call all 95 was hyperbolic).

Obviously, the jury disagreed (or didn't fully understand the law). Or maybe I'm missing something in regards to the mistake of fact defense and castle doctrine. I agree that a murder conviction with a light sentence is a fair outcome, I just don't see how it fits with the law in this case.


It doesn't fit with the law. There really is no law for this case. Per the law as it is written, mistake of fact is an affirmative defense to murder and that was clearly the case here. Is there justice in letting someone off free for walking into a home that is not theirs and taking a life? Is there justice in sentencing someone for a 20-30 year sentence for murder who was a law-abiding citizen when you don't go after career criminals and predators and charge them in that way?

Which is the biggest issue I think all officers are having with this. This is a county that literally handed out probation in plea bargains for murder.

Ironic considering her social media posts and the basic fact that cops deliver unequal justice all day every day when deciding who gets off, who gets a ticket, and who goes to jail, all for the same things.

A white cop shot and killed an unarmed black man. Again. This time in the black man's own apartment while he was eating ice cream and watching TV. Oh and he was an accountant and worship leader at his local church.

She was never going to walk and 99% of it didn't have to do with the facts in this particular case.

What have I been saying throughout this thread? If she was not a white person employed by the police department, this case likely doesn't make it through a grand jury. She was taken to trial and charged with murder in a county that prefers to do neither BECAUSE she was an off-duty officer with white skin. Cruezot has been after his scalp forever and finally got it. You think the police don't know the score? Guyger was made to pay for the perceived and real wrongs done to blacks by the judicial system for centuries.

Think about how many times you break the law every day. Do you really want 100 percent enforcement? Do you want that on your kids?

Guyger was made to pay because she walked into someone else's residence and shot them. You can say this case got more coverage because of race and her profession, but I think the outcome would be the same. I hate that everything has to be about race, from both sides. The people who cry about race-baiters constantly are just as bad as the race-baiters, in my mind.

Here's the thing. If she's not a badass cop with a gum and she thinks that someone broke into her apartment she calls 911.

And a police officer should be able to determine what is and is not a threat to their lives.

A stoned accountant eating ice cream is not a threat to her.

She was ill trained, panicked, and killed a man.

As a police officer, she had a higher accountability to not make this mistake, panic, and kill someone.

Honestly, the failure is with the DPD for giving her a badge and gun.

Based on the DAs history it would not have been taken to trial as murder. She would have been given the option to plea to a lesser charge.

WFAA current discussion seems to indicate that Guyger will not go back on the stand. The attorney they had on yesterday thought the defense had no choice. He said they needed to put her up there to beg for leniency.

She could have been a citizen with a CHL and done the same thing.

Why is it DPD's fault? They should have been able to foresee that 5 years later, she was going to decide to work on her day off to catch some robbers, put in a 14 hour day then come home exhausted and make a horrible mistake?

She is going to get a minimum of 50 years. They are going to throw the book at her as an example. What is the appeal time frame? This case will be overturned on appeal. Can they fast track it?

I know that feelings and emotions shouldn't really be taken into consideration in a court of law...

But damn. You put Botham's texts side-by-side with Amber's texts and you realize how different these two people are, and what a special person Bo was.

The normal person with a CHC doesn't investigate a break in. They call 911. They are also not as well trained as a police officer.

If an officer is not able to perform the functions of a job they have no business being a cop and therefore it's on DPD.

I've heard appeal takes two years. The officer in Balch Springs got 15. I'm expecting 10. I was also expecting not guilty for murder so there is that

Yeah, well, not to **** on cops, but let's be honest, who in their right mind would really want to do that job in a big city these days. This doesn't go for everyone, but chances are you are probably kind of a meathead.

I think it will be relatively light. I think that is going to be the "compromise". Murder conviction with a sentence on the lower end, which is the most correct outcome in my mind.

Yeah, I don't have an issue with law enforcement in general, but most cops I know are fairly ****ty people on a personal level. It's almost worse at the small-town level; a girl I went to HS with just became a cop after a failed career as a hairdresser.

I think the Texas Ranger's testimony, the judge not allowing the defense's expert witness testimony, and that fact that she could not get a fair trial in Dallas County If this trial has been held in Plano or Denton, she is found not guilty of murder. I do believe she should do some time
