The In Memoriam tribute is for members of the Academy only:

The members of the Academy of Motion Picture Arts and Sciences are the organization's greatest asset, an assemblage of the finest artists and craftspersons of the art form.
On this page the Academy pays homage to those members who have passed away this year.
Kobe was denied membership in 2018:

While Bryant was recommended for membership by the short films and feature animation branch, he did not make the final cut, The Times has confirmed, owing to his lack of a larger body of work in the film industry.
I just can't see the Academy going outside of it's established rules to recognize him. Yes, he won an Oscar for his four minute animated short but that was the extent of his work in film. It's also just not worth the potential blowback given his 2003 rape allegations in this post-Weinstein #MeToo era.
Surprisingly, I've seen next to no mention of the rape stuff over the past day or so. If anything, Hollywood, for the most part, seems to be just as enamored with and in mourning of him as everyone else. The only negative Hollywood thing I've seen so far is actress Evan Rachel Wood tweeting about the rape, and she got a ton of sh/t for it. But overall, I think people genuinely appreciate how much he's changed, how great of a father he's become, etc. That, and his God-like status in LA transcends all. He might have even surpassed Magic as
the LA icon. The Academy may not put him in the In Memorandum because of the member/year thing (I didn't think about it being 2020), but I just can't see him not being recognized in some form or fashion. He's too beloved here, and his Oscar win was such a thing, that I think way more people will raise a stink if there's not some kind of mention of him over the people who might raise a stink because of the rape charges.
