Biggest problem I see the idea of a professional intermediary. Same as if a MD tells an LVN to do the wrong thing and the patient dies, or if an engineer tells a equipment operator to do this and there is a cave in and it kills somebody.

Baldwin is clearly a dumbass, but I don't see how you cross that gap.

Was he the last person that could have avoided the accident ? … yeah for sure, but so was the LVN and equipment operator.

I was thinking he might have heard of res ipsa loquitur that implies an accident in certain circumstances implies negligence. But that seldom comes into play in auto accidents, outside of product liability cases. (Exploding Pintos, Firestone tires, etc.)

As I have stated before, on a normal film set, there would have been four pairs of eyes inspecting that gun, three before it ever reached Baldwin. in the case at bar, here, it appears only one pair of eyes inspected it and not in a timely manner. (The AD, before lunch.)

Even if Baldwin does not get indicted, his financial exposure in civil court could be huge in a pure comparative negligence state like NM. That's why I brought up last clear chance doctrine. His allocation will be quite high because of that.

Yep.

He would really be better off not saying a damn thing and not being seen around town. It's not like they don't have enough money to pay people to run errands for them. It's like they're inviting this kind of attention. And I suspect since the wife and he are having their phones out to try to document how they're being harassed, they're going for some kind of sympathy play here that I believe is going to backfire, badly.

Again his arrogance gets him in trouble every time. I feel for anybody this would've happened to and I do not like Alec Baldwin. The problem is that it's hard to garner sympathy for a man who has been so vile for the past six or seven years, calling out every conservative issue, the NRA, mocking others who have done similar things or degrading those like Rittenhouse and others. Now that it has happened to him he's scrambling.

In the end, a lovely young woman lost her life due to negligence on the set. It is very tragic even though I loathe Alec Baldwin and there's a part of me that feels there's some kind of karma involved here but that's even uncomfortable to say. Even when the hubbub about his wife's lies came out he tried to defend it after years of calling other people out for their hypocrisy. He's digging himself a deeper hole here, he needs to shut up. And I would imagine any attorney in his employ would be begging him to do the same.

Too bad he chose to mock the NRA instead of taking a course of theirs to understand how a gun could be loaded. Even one on a set.

Impeding traffic, most likely? They have been spotted all over that town shopping and eating. They aren't keeping a low profile at all. I bet they even have a hired chef to buy groceries and prepare their meals but they just have to be out and about and act all angry that the press is following them around.

Yes, it is a PITA but part of the price for being rich and famous. Baldwin has been known to be very combative with the press, even physically abusive. Nothing new for him. His wife is a nut job.

He's an actor. If he wanted to go for the sympathy angle, he could do better than that. He also writes scripts. He could write that scene better than that, I'd wager. And I bet this PR stunt was designed, just not well thought through, nor well executed.

Baldwin used to know how to act convincingly. He started out on daytime on the soap The Doctors and then prime time soap, Knots Landing. At both of those stops he was around people like Kathleen Turner, Kim Zimmer, Donna Mills, William Devane (that guy chewed up the scenery, his acting cohorts and spit them out routinely) and the like. And he learned. He played demented guys well in both of those roles. Maybe he wasn't acting as much as just being himself?

Very few of the legal analysts that I have watched the last several days seemed to think there was a significant chance of Baldwin being criminally charged. Felt more likely if criminal charges are filed it will be the armorer, assistant AD, whoever introduced the live bullet and put it in the gun (if the cops can figure that out),etc.

Lots of civil liability exposure for Baldwin though.
