No argument from me but that is one of those things that won't happen, unfortunately, as with Hillary being marched of to prison.

Some more winning, in of all places, the 9th circuit (which actually has a lower reversal rate nowadays vs. 20-30 years ago):

Not many asylum seekers with flight plans made before Jan 20th left.

Lot's of judges are happily/willfully compromised. Boasberg definitely will never admit to a voicemail from Gelernt on a Saturday morning at 7:30 or so.

When said judges time and again block the will of the people, we the people should consider the precepts detailed in the Declaration of Independence.

Now, back to my question. I know there is no constitutional basis for federal district judges, and they were established by congress. Did the establishing statute or any precedent decision of SCOTUS grant district judges national jurisdiction?

No. And the number of rulings the district courts falsely apply to the nation have skyrocketed.

And SCOTUS sits impotently by.

Because SCOTUS is, net, on MS-13/CCP's side (which is the Democrats, but I repeat myself).

None of this is really about the pretenses being made of 'due process.' Quite the opposite, actually.
Ellis Wyatt

Due process is merely a talking point they are hoping will appeal to the American public. They know that defending illegals who are in terrorist gangs is not a winning argument. That is still what they're doing, they just want to call it something else.

Maybe they should look in a mirror and examine their values, but the ends justify the means. They don't care who gets killed, they're bound and determined to destroy America.

And why hasn't this jurisdiction issue been taken to SCOTUS a long time ago?

SCOTUS has to be willing to accept a case where they can rule on it and they have steadfastly refused to take it up so far.
MagnumLoad

Who on SCOTUS makes that call?

Also, Congress can solve it. I must say, however, that the ONLY way Congress will be able to accomplish anything meaningful and beneficial, on this or anything else, is to ditch the cloture rule in the senate. They can change senate rules with a simple majority. Courage is necessary, so I am not optimistic.

Supreme Court lack of concrete direction is causing problems.

OK….in the reconciliation bill Congress needs to reduce the size of the federal judiciary.

A sip, oh btw. One of Reagan's mistakes, incredibly.

Separately, a slam on Boasberg in the Hill yesterday:
Quote:

After wheels went up pursuant to the Trump's agreement with El Salvador, federal courts lost jurisdiction full stop. There is simply no platform for a trial judge in Washington to inject himself into this relationship between heads of state.

Further, the judge will probably never live down his flippant remark that the administration "turn the planes around" a comment which reveals a remarkably tone-deaf detachment from reality and the grave risks attached to transporting some of the most violent criminals on the planet. That kind of courtroom bravado is the comment of a partisan actor, not a sober-minded judge.

Apparently not content merely to control the president's foreign affairs authority, the judge's latest stunt threatens the unprecedented appointment of a special counsel to hold the Department of Justice in contempt for the crime of failing to obey his jurisdictionally-thirsty command to turn an airplane around midflight. The judge purports to believe that this matter is about "the rule of law"; yet it seems much more like a game of "gotcha" that a vengeful judge with the help of the Trump-hating media is going to milk in the court of public opinion for all it's worth.

If Boasberg wants to run the executive branch, nobody is stopping him from leaving the bench and running for office. I would encourage him to do so Trump has a lengthy list of candidates qualified to fill Boasberg's seat who actually understand the broad range of executive authority in the realm of foreign affairs and the limited role of federal courts.

But until that day comes, Boasberg should show some humility as tough as that may be and stick to adjudicating disputes within the confines of his territorial jurisdiction.
Good news; more lawfare scum who didn't think the AG could tell them what to do resign from the SDNY DoJ (USA) office.

"You see, your honor, dozens upon dozens of kids were opting out of our wondrous gender and sexuality training and that was making it hard to find space for them all in the library, so we pragmatically just killed the opt-out program as it was infeasible."
Ellis Wyatt

Maybe the degenerates should recognize they should accommodate the students whose parents want them to be indoctrinated with a perverse agenda and put them in the library.

Or they could just teach them and stop social engineering. I realize that's not why liberals enter the education industry, but still…

No minute order appears in the record, meaning that order and memorandum opinion control.

He wanted not to be sent back to Guatemala.

Fox is indicating that DHS has confirmed the SUV Garcia was driving when pulled over in Tennessee with a load of "migrants" was owned by another guy who is a confessed human smuggler.

Makes me wonder if any of this new info or even more details is included.

Attorney General Pam Bondi, in a court filing last week basically says that only the Trump administration can hold the Trump administration accountable for criminal actions.

In other words, "Authoritarian Rule"
