And that kind of points out an issue with that - the reason they were deployed was because the states weren't willing to follow the law regarding the integration of the students so the troops went in specifically DESPITE the opposition of the states.

Better yet, pass legislation to eliminate the DC Circuit. Let the Maryland and Virginia federal districts handle those legal tasks.

That's NOT what they implied.

The key is OUT-OF-STATE guardsmen when there has not been a federalization of the guard.


The Eisenhower/Arkansas situation is easily distinguished on those bases.

That would be problematical with federal banking regulations. They cannot be closed for more than three consecutive days, Last I heard. Maybe that has changed?

No federal law, but some state laws including Texas need approval for extended closure. Seems like supremacy clause covers Trump being able to do this, at least at first brush.
