How hard would it be for Trump to call the president and tell him to do it? Do they not know where he is? Did they drop him in the middle of the jungle? This shouldn't be difficult. They just don't want to do it.

Is this about the guy that someone in the Trump administration said shouldn't have been taken over there after all?

The 29-year-old was detained by immigration agents and deported last month. He had a permit from the Homeland Security Department to legally work in the U.S. and was a sheet metal apprentice pursuing a journeyman license. The DOJ 'accused' him without evidence of being in MS-13 but admitted he should not have been deported to El Salvador.

An innocent victim of Trump's new 'Guilty until proven innocent' deportation laws. He has a wife and 5yr old son (both American citizens btw).

Hey judge! The deportee takes the 11:30 pm Tica bus from San Salvador to Guatemala City. Then the bus to Oaxaca, Mexico, then the bus to Mexico City (south terminus). Then flies Volaris to Houston. Then takes Volaris to Dulles. Estimated cost of travel: <$500. 32 hours travel time.

That comes out of the court's budget.

He was wrongly deported to El Salvador, not wrongly deported

I think I would quibble with this. A "citizen" would have a right to return to the US. Every US citizen who comes to a port of entry has that right.

Abrego Garcia is already subject to a final Order of Removal -- he has no right to return or remain in the US. His only right -- via Immigration Judge order -- was to not be sent to El Salvador by the US.

His remedy lies in correcting that error -- not giving him something he's not lawfully entitled to.

when you encounter the term "facilitate" in legal documents, think of it as a way to simplify processes and promote cooperation. It highlights the importance of support and communication in achieving desired outcomes, whether in business, contracts, or other legal matters.

Sounds simple to me!! Wondering if El Salvidor will welcome surrendering one of their citizens to U. S. custody. Would it violate the terms of the TREATY OF EXTRADITION BETWEEN THE UNITED STATES OF AMERICA AND EL SALVADOR to do so without due process under El Salvidor law? Asking for mi amigo.

He's the husband and father to American citizens, here legally, innocent of any crimes, and is afforded the same constitutional rights of due process as you or I.

The fact the people here can be so laissez-faire about an innocent family being ripped apart because of the ineptitude of these immigration officers is absurd to me.

And the basis for his claim is that he feared gang violence in El Salvador. Now that threat is gone thanks to Bukele. So why shouldn't he enjoy his homeland since the conditions of his asylum claim have evaporated?

I'm so confused

Is he an American citizen? (cannot and should not be deported)
if you aren't a citizen, you can be deported. Who you're married to doesn't matter. This ****s been happening for decades.
So,
Is he on a green card? (green cards can be revoked - person can be deported)
Is he an immigrant here legally on a VISA? (VISA can be revoked, and person can be deported)
Is he an immigrant here illegally? (can and should be deported)

His due process is absolutely NOT the same as a citizen's. He had a deportation order and can be sent anywhere other than El Salvador. He is not innocent. He is illegal and has no right to be in America.

From the Trump court case thread --

Option 2 is to send an Immigration Judge to the U.S. Embassy in El Salvador, bring Garcia to the Embassy, and have a hearing to reopen his case and delete the "Withdrawal" from his Removal Order. That provides him the due process he would have been entitled to in the U.S.

Then he can be escorted to the front door of the Embassy, and released as a citizen of El Salvador in El Salvador.

Let's go back to the SCOTUS Order:

"The intended scope of the term "effectuate" in the District Court's order is, however, unclear, and may exceed the District Court's authority. The District Court should clarify its directive, with due regard for the deference owed to the Executive Branch in the conduct of foreign affairs."

This is a polite way of the Court letting the district judge know that "If what you mean is bringing Garcia back into the United States to appear in your courtroom, you don't have the authority to order that. So be careful in how you clarify your prior order."

He's not coming back here - at least while Trump is in charge.

You cannot be deported without due process. The DOJ has placed the immigration lawyer responsible for the 'clerical error' on Administrative leave. They have publicly admitted that Garcia should NOT have been deported. This was NOT due process.
The Department of Homeland Security issued him a work permit in 2019 and he's been gainfully employed since.
He immigrated here illegally when he was a minor 15+ years ago, sought asylum, and was granted the permit above by the DHS (this was Trumps DHS administration btw).
He literally had LEGAL protection to be here and LEGAL protection from deportation to El Salvador.

Aah. So pretty low on most peoples give a **** meter. People on green cards and visas have been ****ed over for decades, and a lot of my H1 team was ****ed over by the Biden administration, but no one cared until we started deporting illegals, you know, the folks that didn't obey the law in the first place

The irony is that all the H1s fired in bidens great economy had to pay higher fees to the INS, to help cover the cost of processing illegals.
