Because the deportation was done in violation of a prior court order and a Federal court has ordered the government at the very least to attempt to facilitate his return. The Supreme Court, at the very least, agrees 9-0 that the executive branch should attempt to facilitate his return, provide information to the lower court as to what efforts they are making, and give him the due process afforded to people in his situation which frankly isn't much. They could have a quick hearing and get him back out of the country legally. The 4th Circuit today just upheld all of that all over again.

It's because if they do that, they cede Article II powers to these judges. Powers that are not available to these judges. These things set precedents.

The executive branch is rightly protecting its powers from judicial overreach.

By negotiating, which should be very easy considering Bukele is bent over backwards for Trump. Trump has not applied the slightest amount of pressure to ask for this. Would you be okay with Garcia being taken to the US Embassy in El Salvador and having an immigration judge adjudicate his case there? Then returning him to El Salvador's custody? Embassy is considered American soil. That's a return. Immigration judge vacates the holding order since the rival gang problem is no longer an issue under change in circumstances. No holding order, deportation to El Salvador (right outside the embassy grounds) is no longer an issue.

But have to remember how he was swept up in the first place, parking lot hanging out with other gang members. Birds of a feather, after all.

I don't think people understand how ever living ****ed that guy is. He probably will never see the light of day again. I don't like it, but it is what it is right now.

People actually think we are going to force El Salvador to release an El Salvadoran in the USA? Do they think Biden is still in office?!

The best thing this guy can hope for is some clemency from Bukele. Maybe the Vatican or a human rights organization could get involved and sway him. Either way, he's likely spending the rest of his life in his home nation.

They have provided daily status reports.

Most of them say "He's there. He's alive. We can't tell you exactly what we're doing because that's sensitive foreign policy information. See you tomorrow." Which is all they actually have to provide.

Didn't President Bukele say in the Oval Office he was not returning him? Why doesn't that end the matter as far as his case. Sure Trump probably didn't try as hard as he did for Americans held in other countries, but why should he? He doesn't want him back.
