IMMIGRATION CHARGE: Abrego-Garcia has made no claims to USC or LPR and is amenable to removal under 212(a) (6) {A) (i) of the Immigration and Nationali.ty Act, as amended, in that Abrego-Garcia is an alien present in the United States without being admitted or paroled, or who arrived in the United States at any time or place other than as designated by the Attorney General.
Abrego - Garcia claims to be in good health. one free phone call. Abrego-Garcia made a call to ----at --and remained for 5 minutes. Abrego-Garcia is not claiming fear of returning to his country.
Garcia may be embellishing his entry process... "walking across the desert to enter into U. S. via McAllen"- Ain't no way from Monterrey NL to McAllen is a 'desert'.
He is not claiming 'fear to return' to his country until he was confronted with the possibility of speaking with an El Salvidor consular official.
