People can criticize the plea deal all they want but when the defense knows that the key witness is not willing to testify they have a ton of leverage in negotiations.

Prosecutors having to take lesser plea deals due to witnesses not cooperating is pretty common. If this is the albatross Talarico is going to try to hang his hat on he's going to fail.

Adam Hoffman was charged with continuous sexual abuse of a young child, which is a Class A Felony, and carries aa 25 year to life sentence. The AG's office was handling the case because the local DA's office had recused themselves (rightfully so, as Hoffman was a local attorney who had dealings with the local DA). At trial, the jury hung 7-5 in favor of a finding of guilty. There were some inconsistencies in the child's testimony, and allegations that Waco PD had botched the investigation at the outset. The AG's office offered a deal of two counts that were Class A Misdemeanors, which would have a sentencing maximum of 1 year, but offered a sentence of time served (I believe he had spent 1 day in jail at the time). They supposedly offered the deal because the child was unwilling to testify at the second trial (this fact is somewhat in dispute). Hoffman took the deal, and when it came to sentencing, the judge was rightfully pissed and increased the sentence to 60 days, the most the judge could do. Hoffman was released from jail this week after serving 29 days.

The first trial was for a Class A Felony that carried a 25 to life sentence. The jury hung 7-5 in favor of guilty. But he was never sentenced. IMHO, I think the AG's office didn't handle the case well, but I also think they were hamstrung a little by a sloppy Waco PD investigation.
