GiveSendGo has now surpassed $400K with a new listed goal of $500k. I believe the original goal was $100K and each time the goal is met, the goal posts move and higher a goal is entered.
And the higher the retainers for defense counsel go. All for naught.
I don't think this even goes to trial. Plea deal for manslaughter, heat of the moment type, ten years, out in five with good behavior, maybe even less than five.
No reason to take it to trial.
That would be amazing work by the defense. But if I was the prosecutor, no way I would offer 10 on manslaughter. I think I could convict him of murder and get at least 25 at trial and he would have to go to trial to get less than that from me.
He will not be out in less than 5 because under no foreseeable circumstance would they offer a single digit number and because of the deadly weapon finding, he must serve at least half and will not make his first parole.
Tom, I love that you only bring the good news on this.
Thanks. People hire me because I always shoot them straight and that is the advice I would be giving Karmelo. A 20 to 25 plea offer would be hard to turn down or beat at a trial. It is all downside risk.
His only viable defense is to hope for jury nullification.
He will not get heat of passion because I have never seen that successfully argued outside of the family context. Imperfect self defense is a unique animal in Texas that requires deadly force to still be justified and proportional, but gives you that defense if you were the initial provocateur. He will not get manslaughter because this was intentional, not reckless conduct.
He is fooooked.
