A competent prosecutor should be able to prevent that with Collin County being only 10% black. I would want a mostly white and hispanic male jury. Hispanic females would be my second choice. I think I could limit it to that.

Exactly. I don' care what names he was called, don't care if he was abused as a child, don't care if he was malnourished growing up, don't care if he is 14 years old. He took a life and should lose his because of that. I only wish it was slow and painful and public so it might cause others to not do the same thing this guy did.

I think so. But a sufficient number of family members hides his direct involvement. A hallende to get past since he will be emancipisated as 18 soon.

I have not looked at his funding page, but I can just about guarantee you It is set up so that someone else receives the money and covers "helping the family" as the purpose.

Thus, it's never actually his money and they can do with it as they choose broadly "helping the family"

You don't need a criminal conviction to win a civil suit (OJ ring a bell?). That said, it's probably easier to win a civil suit once there's a criminal conviction so they'll probably wait. Hopefully Austin's dad sees them celebrating the ghetto lotto and is planning accordingly

Again a competent prosecutor will not have any black on the jury. But even if one gets on and this thing ends with a hung jury, as long as the DA is committed to slamming this turd, they will get him. They could try him 10 times if necessary. For him to be acquitted, it needs to be unanimous. No way that happens in Collin County.

I have tried someone 3 times before I got my conviction.

Not if you focus your voir dire questions on blacks and white women, which I would do. There is zero the court can do if you come up with a race neutral reason to remove them. Which would not be difficult, since there will only be a handful of blacks on the venire panel to begin with.

I tried over 30 first chair criminal jury trials as a prosecutor and regularly removed my black and younger jurors as a matter of course. Thanks for the tip though.

As a defense attorney, I have never had a sustained Batson challenge and only know of one in the past seven years in my county.

I will agree with you, that might be thing to do. But having worked many years around kids like this for years, I know rules of engagement have changed. You could get stabbed in the back walking away-- they dont follow noble causes, nor care about consequences of their actions. They have either never been held accountable, or they are so sick they do not care if they live, or if they are incarcerated for the rest of their miserable life.

For sure. I am not afraid of walking backwards. If someone is a threat I don't turn my back to them.

I think the lack of fathers in the home is the biggest issue. A woman cannot teach a boy to be a man any better than a man can teach a girl to be a woman. Men and women are very different in how we think, processes, and react. It's to mankind's benefit that we be different. You have these boys raised by women who often respond in emotion first. But they still have the man's instinct to be respected and admired and to be a person of action. When they don't have a man around to call out the man in the boy, the boy ends up responding in these emotional outbursts of violence. It changes the culture so that even if you are raised in a strong two-person household, if you are spending significant time around these others, especially in adolescence when the opinions of your peers is most important to you, you are likely to also act this way.
