EDIT: And Tom would be right. Autopsy report probably not in yet. The ME's Office for that areaSWIFS does work over a huge area. From the Hill Country up to the Red River and out to west Texas. They are the ones I used for just about all murder cases.

Aah, that explains it then. Thank you for that clarification. Makes sense now. Prelim autopsy is done but tox and tissue samples not in yet.

Also, when Anthony was arrested at the scene, were his hands forensically tested? Scrapings from fingernail, blood on his hand collected, etc.? Those tests could be outstanding as well. We already have his confession he stabbed him. But DNA from Austin on Anthony's hand(s) is also important.

Now, that having been said, do I think Anthony has that caliber of defense attorneys? Don't know.

But for prosecutors stick to what you have nailed down. Not a jury expert by far but my belief is the simpler a prosecutor makes it for the jury to understand and follow, the better for your case.

Jury selection is paramount in this case.

But how do they have manslaughter "nailed down" but not murder. How did he recklessly kill Metcalf? He did it intentionally and we know that because he asked about self defense. I'm sure there is an interview with the defendant where he says he was afraid and that is why he stabbed Metcalf. That is not reckless conduct.

His self defense claim will fail because his use of deadly force was not a proportion response.

This is murder. He will be charged with murder. I cannot even conceive of a reason why he would not charge murder. I was a Texas state felony prosecutor for years and am now a defense attorney.

I represent black clients for murder on the regular. They have zero issue charging them.

Hell, they should get me and my guys in as special prosecutors. We are all former felony state prosecutors. For $1.5 million, we will shut down the office for a few months and get this fool 30+ years on murder.

It will be an all white male (no white females) and hispanic petit jury.

This is an easy case for the state.

No specifics needed, just a yes or no.
The notoriety may affect the proceedings and court system as the threat of riots may increase.
We really need to rewrite our laws concerning libel and slander.

The ones of us who have worked in the criminal justice system could tell stories that are almost unbelievable about certain segments of our society. But then we would get a perma ban.

And I have just returned from Muster so I want to enjoy the wonderful things about our society and about being an Aggie.

So far now no more thoughts of criminals.

Is anybody in LEO actually monitoring this POS? I cannot recall such a case where an accused murderer who is a nobody has been given such preferential treatment in my life.

If you read through it, a few things stand out.

He told Austin to touch him, then told him to punch him while searching through his bag. That sounds like instigation and premeditation to me. Also, he cried like a little ***** after the police arrested him.
